2.1 Part II of these Terms shall govern your obligations with regards to your use of this Website in general as well as all accounts you may set up on this Website. By using this Website, you accept without limitation or qualification, the Terms in Part II and any additional terms set forth in any related website.

2.2 Part III governs account creation, participation and pre-booking of a XPENG Vehicle hosted at shop.xpeng.com.sg. By registering for an account and pre-booking a XPENG Vehicle with a Deposit, you accept without limitation or qualification the terms in part III and any additional terms communicated to you as a Participant. Participants are responsible for keeping themselves informed of the current Terms of the Sale. Continued participation will be regarded as acceptance of the current Terms. Premium reserves the right to change any of these Terms at any point in time. Changes made will be posted here with immediate effect, so please check this page often. If you do not agree to the Terms contained herein, please do not use this Website.

Part II: Terms and Conditions of use of Website

3. User submissions

3.1 All user submissions will become Premium sole and exclusive property and shall not be returned to you. You shall not use a false email address or mobile number, pretend to be someone other than yourself or mislead Premium or third parties. Premium may, but shall not be obligated to, remove or edit any submissions.

3.2 When you register for the pre-booking on the Website, you may receive information emails (such as SMS, newsletters, confirmation emails, information on offers, offers from Premium related companies and principal). You can unsubscribe from such information emails at any time by sending an email to unsubscribe. Please note that if you unsubscribe from such information emails, you will not be able to access and or receive any details regarding the Sale.

4. User obligations

4.1 You warrant that all information provided during account registration is true, complete and accurate and that you will promptly inform Premium of any changes to such information by sending an email.

4.2 Without limitation, you undertake not to use the Website and/or any information obtained from the use of the Website for any fraudulent purpose or any purpose other than what Premium has intended for them to be used.

5. Copyright and trademarks

5.1 All content, pictures and other works published on Website are subject to the copyright of XPENG and its affiliates, including but not limited to Premium, if not otherwise indicated. Any duplication, distribution, storage, communication, broadcast and reproduction or transmission of the contents without XPENG's written approval is prohibited.

6. Indemnity

6.1 You agree to indemnify, defend and hold Premium, all Premium subsidiaries, affiliates, subcontractors, agents, directors, employees, officers, information providers, advertisers or partners, licensors and licensees, (collectively “Indemnified Parties”) harmless from and against any and all liability and costs (including, without limitation suits, litigation costs, attorneys' fees, of any kind and nature), incurred by the Indemnified Parties in connection with any claim arising out of your access to and/or use of the Website or any breach by you of these Terms of the foregoing representations, warranties and covenants or any other actions connected with the use of the Website. You will cooperate as fully as reasonably required on Premium' defence of any such claim. Premium reserves the right at Premium' own expense to assume the exclusive defence and control of any matter otherwise subject to indemnification by you and you will not in any event settle any matter without Premium' written consent.

7. General provisions

7.1 Premium administers the Website from the Premium' office in Singapore. All content on the Website has been prepared in accordance with the laws of Singapore and may not satisfy the laws of any other country. Premium makes no representation that the Website is appropriate or available for use outside Singapore and access to the Website from territories where its contents are illegal or restricted is prohibited. If you choose to access the Website from outside Singapore, you do so, on your own initiative and are responsible for compliance with applicable laws.

Part III: Terms and Conditions of creating an account, participation and pre-book of a XPENG Vehicle

8. Deposit

8.1 In order to pre-book a XPENG Vehicle on the Website, users will need to create an account, select a unit and make a Deposit. Premium will not be liable and you are independently responsible for complying with all applicable laws related to your use of our payment gateway's services.

9. Refund policy

9.1 Deposit will not be refundable if Participant did not complete the test drive with their Sales Executive, after their pre-booking.

9.2 Deposit will only be refundable if Participant decides not to proceed with the purchase, after completing the test drive.

9.3 Upon fulfilment of Clause 9.2, the full refund of the Deposit will be credited back to the credit card used for the purchase.

9.4 Refunds will be processed within 10 working days. It will be credited back to your credit card within 3 to 30 working days, depending on your credit card issuing bank.

9.5 Premium reserves the right to reject any requests for refund that do not fulfil our Terms or for any other reason whatsoever.

10. Premium rights and limitation of Premium liability

10.1 Premium shall not be liable for, nor be bound by, any statements, representations made or actions taken, of any third party, including any party which Premium may have engaged to assist Premium in the administration of the pre-booking and/or any telephone helpline, email associated therewith.

10.2 Premium reserves the right, in its absolute discretion, to withdraw or terminate the pre-booking without liability or change any of the applicable Terms without prior notice.

11. Personal data

11.1 In order to carry out the pre-booking, Premium needs to keep personal data, including but not limited to name, email address and contact number of each Participant. Some of this data may be shared with suppliers and other parties providing support for the pre-booking. When a user participates in the pre-booking, personal data may also be collected and stored.
